UND Academy — Legal
Enrollment Agreement
Effective date: August 25, 2026
1. Parties & Scope
This Enrollment Agreement (“Agreement”) is between Universal Network Development LLC, d/b/a U.N.D Industries (“UND,” “we,” “us”), and the individual enrolling or the parent/legal guardian enrolling a minor (“you,” “Parent”). This Agreement governs all tutoring services provided through UND Academy.
By completing enrollment and payment, you agree to all terms below. If you are enrolling a child under 18, you are the contracting party — minors cannot form enforceable contracts under applicable law.
2. Parental Responsibility
If you are enrolling a minor:
- You represent and warrant that you are the parent or legal guardian of the student.
- You accept full financial responsibility for all charges. All billing goes to your Stripe account.
- You are the sole authorized contact for scheduling, billing, and data requests.
- For students under 13, you provide verifiable parental consent (VPC) per COPPA by completing payment and the enrollment consent checkboxes.
3. Age Attestation
You warrant that the date of birth provided during enrollment is accurate and truthful. Providing a false date of birth constitutes fraud. If UND discovers that a student’s actual age differs from the attested age, UND reserves the right to:
- Immediately suspend the account pending verification
- Retroactively require COPPA parental consent if the student is under 13
- Terminate the enrollment without refund if the misrepresentation was intentional
You bear full legal liability for any consequences arising from a false age attestation.
4. Hour Packages & Pricing
Tutoring hours are sold in packages of 5, 10, or 20 hours. Pricing is set per course tier as listed on the Academy enrollment page and stored in our database. UND reserves the right to change pricing for future purchases; existing purchased hours are honored at the original rate.
- 5-hour package: full listed rate
- 10-hour package: 10% discount
- 20-hour package: 15% discount
5. Refund Policy, Attendance & Cancellation Shield
- Delivered Hours Are Final: Lessons that have been conducted and logged in our attendance ledger are strictly non-refundable. Automated session timestamps and instructor logs serve as conclusive evidence of service delivery.
- 24-Hour Rescheduling Notice: Tutoring sessions must be rescheduled with at least 24 hours advance notice. Because instructors reserve their time exclusively for your session, cancellations made with less than 24 hours notice cannot be credited.
- 15-Minute No-Show Rule: If a student fails to join an active online session within 15 minutes of the scheduled start time, the session is marked as a student no-show, the instructor is released, and 1 hour is deducted/forfeited from the purchased package to compensate the instructor.
- Unused Hours Refund Window: Unused hours may be refunded within 90 days of purchase upon written request to [email protected]. After 90 days, unused hours expire and are non-refundable.
- COPPA Revocation Refund: If COPPA consent is revoked by a parent, all remaining unused hours are refunded automatically within 5–7 business days.
- Chargeback Waiver: By enrolling, you agree to contact UND support to resolve billing inquiries prior to initiating a payment dispute with your card issuer. In the event of a fraudulent or bad-faith chargeback on delivered hours, UND reserves the right to submit attendance logs and IP records as conclusive proof of fulfillment, recover dispute fees ($15), and refer unpaid balances to collections.
6. Session Recording & Florida Law
All tutoring sessions are recorded for the safety, protection, and educational benefit of all participants. Florida is an all-party consent state (Fla. Stat. § 934.03). By enrolling:
- You consent to the recording of all sessions.
- If enrolling a minor, you consent on behalf of your child to being recorded.
- All participants (instructor and student) are informed that sessions are recorded before each session begins.
- Recordings are stored securely, accessible only to you (the parent, if applicable), the instructor, and UND administration.
- Recordings are never shared publicly, sold, or used for marketing.
- Recordings are retained for no more than 12 months after the last session, then permanently deleted.
Violation of Florida’s all-party consent statute is a third-degree felony. UND takes this obligation seriously and maintains strict compliance.
7. COPPA Consent (Students Under 13)
For students under 13, this enrollment constitutes your verifiable parental consent under COPPA (16 CFR § 312.5). By completing payment and checking the COPPA consent box, you consent to UND Academy collecting your child’s:
- First name
- Date of birth
- Course progress data
This data is used solely for educational instruction as described in our Children’s Privacy Policy. You may review, delete, or revoke this consent at any time through the Parent Portal or by emailing us.
8. Acceptable Use & Code of Conduct
Students and parents agree to:
- Treat instructors and staff with respect and professionalism.
- Not share account credentials with any other person.
- Not redistribute, copy, or share course materials, lesson content, or recordings.
- Not use sessions for any purpose other than education.
- Not engage in harassment, threats, or abusive behavior.
Violation may result in immediate termination of enrollment without refund.
9. Intellectual Property
All course materials, lesson content, recordings, curricula, and educational resources are the exclusive intellectual property of Universal Network Development LLC. No license is granted to reproduce, distribute, or create derivative works from any UND Academy content without prior written consent.
10. Educational Disclaimer & Student Effort Requirement
UND Academy provides supplemental educational instruction, mentorship, and instructional frameworks on an “as-is” basis. Educational tools, software, and artificial intelligence do not automatically or magically impart knowledge, intelligence, or capability. Genuine skill acquisition and comprehension require substantial student effort, independent practice, active cognitive engagement, and homework completion.
UND expressly disclaims any guarantee or warranty regarding:
- Specific academic grades, grade point averages, or class ranks
- Standardized test scores (including AP Computer Science exam results)
- College, university, or specialized program admissions
- Employment, internship, job offers, or financial outcomes
UND Academy is an educational tutoring service, not an accredited degree-granting school. We do not issue academic credit, diplomas, or degrees.
10A. Parental Oversight & Student Practice Responsibility
If you are a parent or guardian enrolling a student:
- You acknowledge that tutoring sessions represent only a portion of the learning process. You agree to ensure that your student actively engages with assignments, practices the techniques demonstrated, and utilizes the tools responsibly.
- UND instructors are educational mentors and coaches, not childcare providers or babysitters. For students under the age of 14, an adult parent or guardian must remain in the home or general vicinity throughout all remote sessions.
- You are responsible for ensuring the student maintains suitable computer hardware, a stable internet connection, and a distraction-free learning environment.
10B. Third-Party AI Tools, Academic Integrity & External Costs
As part of modern tech instruction, students may be introduced to third-party artificial intelligence models, code editors, and cloud developer platforms (e.g., Cursor, Claude, OpenAI, GitHub, Supabase, Cloudflare):
- Independent AI Outputs: AI models generate probabilistic outputs and may occasionally generate inaccurate, incomplete, or hallucinated code or information. UND does not control and is not liable for outputs generated by third-party AI models.
- Academic Integrity: Students and parents remain solely responsible for complying with the honor codes, plagiarism policies, and academic integrity guidelines of their primary schools or universities. UND Academy tools and training are designed to foster learning, problem-solving, and architecture skills — not to assist with unauthorized cheating or academic dishonesty.
- External Tool Accounts & Billing: UND is not responsible for any independent third-party subscriptions, API usage fees, or cloud infrastructure charges incurred by the student or parent outside the direct hourly tutoring fees paid to UND.
10C. Screen-Sharing Environment & Limitation of Liability
During interactive screen-sharing sessions, the student drives the screen. The student and parent are strictly responsible for closing all personal files, private photos, financial documents, confidential communications, and browser tabs before initiating a screen-share. UND and its instructors bear zero liability for unintended visual disclosure of items present on the student’s desktop or browser.
To the maximum extent permitted by law, UND’s total aggregate liability for any and all claims, disputes, or causes of action arising out of or related to this Agreement or the tutoring services shall be strictly limited to the actual amount paid by you to UND for the specific hour package giving rise to the dispute.
11. Anti-Defamation
You agree not to publish, post, or disseminate false, misleading, or defamatory statements about UND Industries, UND Academy, its instructors, or its services. Nothing in this section restricts your right to post honest, good-faith reviews or to report concerns to appropriate authorities.
12. Dispute Resolution
Any dispute arising from this Agreement shall be resolved through binding arbitration conducted in Orange County, Florida, under the rules of the American Arbitration Association. Each party bears its own costs. You waive any right to a jury trial or to participate in a class action.
Before initiating arbitration, you agree to contact us at [email protected] to attempt resolution informally. Most disputes can be resolved without formal proceedings.
13. Termination
Either party may terminate this enrollment at any time. Upon termination:
- Unused hours are refunded per Section 5.
- For minors, all personal data is deleted per the Children’s Privacy Policy unless the parent requests otherwise.
- UND may terminate enrollment immediately for violations of the Code of Conduct (Section 8) without refund.
14. Governing Law
This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law provisions. Federal law (including COPPA) applies where applicable.
15. Changes to This Agreement
We may update this Agreement from time to time. Material changes will be communicated via email to the address on your account at least 14 days before taking effect. Continued use of UND Academy after the effective date constitutes acceptance. No change will retroactively reduce protections for data already collected from children.
